By downloading, installing, or using the Forge mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
Forge is a mobile alarm application for iOS that allows users to set alarms, select custom alarm sounds, and manage alarm schedules. The App is provided free of charge.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on Apple-branded devices you own or control. You may not:
You agree to use the App only for lawful purposes and in a manner that does not infringe the rights of others. You are solely responsible for ensuring the App's alarm functions meet your individual needs, including for time-sensitive situations.
All content, design, graphics, sounds, logos, and code within the App are the intellectual property of Forge App or its licensors. Nothing in these Terms transfers any intellectual property rights to you. The "Forge" name and logo are trademarks of Forge App.
The App is provided "as is" and "as available" without warranties of any kind. We do not warrant that alarms will fire in all circumstances, including device silent mode, low battery, or operating system restrictions. Reliance on the App for critical wake-up events is at your own risk.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FORGE APP EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, FORGE APP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF INCOME, MISSED APPOINTMENTS, OR ANY DAMAGES RESULTING FROM FAILURE OF AN ALARM TO ACTIVATE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM (WHICH, FOR A FREE APP, IS ZERO DOLLARS).
The App is distributed through the Apple App Store. Your use of the App Store is subject to Apple's Terms of Service. We are not responsible for Apple's services, policies, or practices.
We reserve the right to modify, suspend, or discontinue the App at any time without notice. We may also update these Terms at any time. Continued use of the App after any changes constitutes your acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in courts of competent jurisdiction.
